UNITE STUDIO TERMS AND CONDITIONS 

Unite Movement Pty Ltd (ACN 668 957 771) operates Unite Studio in Shepparton, Victoria, Australia. Please read the terms and conditions thoroughly before signing up. Please read these terms and conditions (the ‘Terms’) carefully. By becoming a member on a direct debit, package, taking a class, paid or otherwise, this signifies that you have read, understood, and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the studio, or any of Services, immediately. Unite Studio reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Unite Studio updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records.   ​

 General terms and conditions  

Unite Studio reserves the right to refuse entry to, or eject from our Studio, clients or others who are behaving in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner or in any manner which may threaten the security of our clients or other people at the Studios. 

 You are required to follow all reasonable directions of Unite Studio staff and instructors while at the studio. 

 Smoking is prohibited inside and out the front of our Studios at all times. 

You are required to treat all persons and property at the Studios with all due care and respect. 

Participants are required to wear appropriate attire for physical exercise at all times while visiting our studio, and must refrain from wear clothing which contains offensive prints or designs or which may presents a danger to themselves. For hygiene purposes, socks must be worn at all times during your workout. Specialised Studio Pilates grip socks are available for purchase in studio. 

In order to minimise disruption during classes held at our Studios, we recommend that you aim to arrive at least 5 minutes prior to the scheduled commencement time of a Class. Once the class has started, the instructor reserves the right to refuse you participating and your reformer may be given to someone on the waitlist.  

Group classes run for a total of 45 or 55 minutes, depending on the class type. 

Please let your instructor know prior to the class commencing if you have any injuries, concerns, or are pregnant. 

Clients are strongly discouraged from departing classes prior to their scheduled conclusion time as it is disruptive to the enjoyment of other students attending those classes 

For all Pilates group classes there is a 4 hour cancellation window. Sign into your account online, via the app to early cancel your booking and avoid being charged the full class fee. 

For the enjoyment of all participants in your class and as a courtesy to others, mobile phones are not to be used during class. Please keep your phone switched off or on silent in your bag. e on call for example. 

Unite Studio is a family friendly venue, and we permit the attendance of children into the studio. However, the child remains the responsibility of their parent/guardian at all times. Disruption should be kept to a minimum out of respect to fellow participants and their ability to focus and engage with their reformer class experience. 

You must be at least 16 years of age to participate in group classes. Any students under 16 years of age must be signed in and accompanied by a parent or guardian. 

All purchases are final. Unite Studio will not provide a refund for missed classes for change of mind, temporary ill health or otherwise.  

You acknowledge that our instructors may use tactile cueing and adjustment methods or make physical contact with you for correction purposes. This type of instruction is in place to ensure safer practice and limit of injury to clients while exercising. By taking part in a class, you acknowledge that you accept this method of instruction and take part in the class at your own risk.  

Bookings 

Class bookings are essential and must be made through the Unite Studio app or our website. There are a set number of spaces in each class. To attend a class, you must reserve a space. To sign up to participate in our classes you must create an account with us. Your account will be governed by these terms and conditions and privacy policy (see below).  

Bookings can be made 30 days in advance. 

If a class is full, you can add yourself to the waitlist. 

Sessions cannot be used by anyone other than the person booked into the class. If someone other than the person booked in arrives to use the session, they will be turned away or asked to purchase their own session. 

Pricing and offers 

Our current prices and timetables are displayed on our website.   

Unite Studio may, from time to time, vary its prices to take account of, amongst other things, any change in the cost of providing the goods and services, by providing prior written notice to you. Any changes to the prices will take effect from the date specified in the notice.  

All prices quoted for goods and services include GST, unless otherwise specified. 

General Terms & Conditions of Unite Studio Intro Offer. 
The Intro Offer is for new clients only. The Intro Offer expires 14 days after the use of your first class. The Intro Offer is non-refundable and non-transferable. Please see our Cancellation Policy below regarding Cancellation of your class.

General Terms & Conditions of Unite Studio Class Packs. 

Class packs are non refundable and non transferable. They must be used prior to their expiry date. 

Class Packs 

All classes must be pre-paid before attending. Payment must be made prior to booking,  via a pre-paid pack or as a casual attendee. 

Class packs are non-transferrable between holders, and may not be sold, traded, gifted, shared, provided or otherwise transferred to any person other than the purchaser, with the exception of class pack gift vouchers, purchased via emailing pilates@unitestudio.com.au    

Each class pack contains a strict expiry date.  No extensions are permitted to the specified expiry period and no refund will be given for any unused classes.  

The sale of a class pack is final.  Unite Studio does not offer any refunds, transfers, suspensions or extensions on class packs for illness, injury, change of mind, user error, change of address, unsuitability or any other reason. 

Class packs are valid for group Pilates classes and are not redeemable for any private session. 

Studio class packs may be purchased as follows: 

  • Single visit 

  • 5 class pack (expiring 2 months from the date of purchase) 

  • 10 class pack (expiring 4 months from the date of purchase) 

  • 20 class pack (expiring 6 months from the date of purchase) 

We reserve the right, in our discretion, to suspend or terminate your use of any Unite Studio class packs if we suspect any fraud or misuse of our booking system. 

Cancellation Policy  

Cancellations or rescheduling group classes must be done through our Unite Studio app or by emailing our studio directly at pilates@unitestudio.com.au.  

Cancellations must be made at least 4 hours prior to the class start time to avoid losing your session credits. Cancellations made with less than 4 hours notice will incur the full cost of the cost of the class booked.   

There is a strict 12 hour cancellation policy for private sessions. If you fail to cancel within this time, you will lose your session and the full amount will be deducted from your account or pack. 

If you know you will not be able to make a class for which you have booked, within the 4 hour cancellation window, we strongly encourage a cancellation to be made, so that another person may take your reservation on the reformer. 

If you are late to class, you will be permitted into the studio at the instructor’s discretion.

Schedule Changes 

Unite Studio reserves the right to make changes to the class schedules, opening hours, membership pricing and instructors at any time.  You will be notified of any permanent changes to our opening hours. 

Waitlists 

If a class is full, you can add yourself to the waitlist. If there are any cancellations, you will be notified via email up to an hour before the class commences. 

When adding yourself to the waitlist you are committing to attend that class should a space become available. Please remove yourself from the waitlist if you no longer wish to attend to avoid a fee or loss of class credit, either online or via the Unite Studio app. Once you have been confirmed in the class from the wait list, our 4- hour cancellation policy applies, and a cancellation fee will apply if cancelled within this time. 

Security 

You are responsible for the loss, theft, or breakage of any personal belongings you bring into the studio. Unite Studio is not responsible in any way for the safekeeping of your personal belongings that you bring into our studio.  

As such, we strongly recommend that you: 

  • Refrain from bringing any valuable personal belongings into our studio, such as mobile phones, jewellery, personal devices, wallets, bags, and purses; 

  • Bring only any personal belongings into our studio which are absolutely necessary for you to possess for the duration of your visit; and 

  • Store any personal belongings in the studio storage facilities provided for use for the duration of your visit. 

Pregnancy 

Unite Studio can accommodate pregnant clients under 14 weeks in all classes unless you are experiencing complications in your pregnancy. Once pregnancy reaches 14 weeks, it is required that you stop attending the standard classes unless approved by the instructor. 

Specialty Pregnancy Classes are offered (see timetable) and are instructed by pre- and post-natal exercise trained myotherapists. These speciality pregnancy classes are safe for women to attend throughout their entire pregnancy up to full term, if they feel comfortable to do so. 

Pregnant clients over 16 weeks are only permitted to attend Reformer Pilates classes with trained pre- and post-natal exercise-trained instructors Alison Potter and Anna Gee. 

If you are new to reformer Pilates, we highly recommend starting with a private session in order to learn the modifications required for pregnancy. 

Pregnant clients must provide clearance from your doctor, women’s health physio or OBGYN to participate in reformer Pilates classes. If you are booking into a general class, please let your instructor know of your pregnancy prior to the class via email pilates@unitestudio.com.au. 

Your Personal Information and privacy 

Your personal information collected by us in accordance with these Terms and Conditions will at all times be dealt with in accordance with our Privacy Policy, a copy of which can be viewed in full upon request. 

Your personal information will only be used by Unite Studio or our direct debit provider to provide you with the services within the Direct Debit Request or our studio terms and conditions. Unite Studio will only disclose such information to third parties to the extent specifically required by law. 

You must not photograph or record other users in Unite Studio without their express consent. 

You consent to Unite Studio use of your image in any promotional materials, including on Unite Studio’s social media accounts. 

Limitation of Liability 

Except for any liability that cannot be excluded by law, Unite Studio (including its officers, employees and agents) excludes all liability (whether under the law of contract, tort or otherwise), for any personal injury, loss or damage (including but not limited to loss of opportunity, loss of reputation or goodwill, loss of privacy or loss or corruption of information or data); whether direct, indirect, special or consequential, arising in any way out of your attendance at our classes. This includes but is not limited to any theft, unauthorised access, or third-party interference. 

This limitation of liability applies even if Unite Studio has been expressly advised of potential loss. 

By participating in our classes, you agree that our liability for any death, physical or mental injury (including aggravation, acceleration or recurrence of any such injury), the contraction, aggravation or acceleration of a disease, the coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs that is or may be harmful or disadvantageous to you or the community, or that may result in harm or disadvantage to you or the community, that may be suffered by you as a result of the supply of recreational services by Unite Studio is hereby excluded, save that this limitation of liability does not apply to significant personal injury suffered by you as a result of reckless conduct by Unite Studio in supplying the recreational services.   

You accept that your use of the facilities provided by Unite Studio or at Unite Studio is at your own risk and you acknowledge that the use of the facilities may involve risk or injury whether caused by you or another party. By accepting these Terms and Conditions you agree that Unite Studio will not be liable for any personal injury suffered on club premises, or from using our facilities or equipment, unless due to the gross negligence of Unite Studio. 

Medical Warning and Acceptance of Risk 

Prior to undertaking any new form of exercise, you should consult with your doctor or other healthcare practitioner to ensure that you are mindful of your current health and any restrictions that may be appropriate for you.  

 Participating in Pilates is undertaken at your own risk.  

You must notify your instructor if you have any pre-existing injuries or medical conditions which may impact upon your ability to perform the exercises in our classes, prior to the commencement of the class, and ideally at the time of booking. You must also seek medical advice and inform the studio should you become aware of any changes to your health during your membership at our studio. Participating in any form of exercise at our studio with a Medical Condition is done entirely at your own risk. 

By attending our studio and participating in Pilates classes, you will be performing physical activity and exercise which has an inherent risk of personal injury.  

When participating in our classes, do not overexert yourself and work at your own pace. Stop immediately if you feel pain or discomfort.  You should immediately seek medical attention if there are any unanticipated changes to your physical condition at any time.   

By undertaking any exercise program (including the use of any equipment purchased from us), you acknowledge that you do so at your own risk that that the creators, producers, instructors and distributors of our exercise programs (together with their servants and agents) will not be liable for any personal injury, loss or liability of whatsoever nature arising as a result of, or in connection with, your undertaking of any such exercise program or following advice contained on our website or given by our instructors. You acknowledge that whilst every attempt is made to ensure that the recreational services and facilities provided by Unite Studio are safe, there are some significant and inherent risks involved and you agree that you are participating voluntarily and at your own risk and responsibility, thereby exposing yourself to certain risks. 

All new students are required to sign a liability waiver upon sign-up. 

Jurisdiction 

The law of Victoria from time to time governs the Terms. The parties agree to the non-exclusive jurisdiction of the courts of Victoria, the Federal Court of Australia, and of courts entitled to hear appeals from those Courts. 

Unite Studio’s failure to enforce any of these Terms shall not be construed as a waiver of any of Unite Studio’s rights. 

Merchandise, Accessory and Clothing Refunds and Replacements 

As per the ACCC Guidelines, Unite Studio is not required to provide a refund or replacement if you change your mind. Unite Studio is not able to offer the repair of damaged or faulty items, but you can choose a refund or replacement of an item within a reasonable time period.  

Force Majeure 

Unite Studio is not liable in any way howsoever arising to the extent that it is prevented from acting by events beyond its reasonable control including, without limitation, industrial disputes, strikes, lockouts, accident, breakdown, import or export restrictions, acts of God, acts or threats of terrorism or war. If an event of force majeure occurs, Unite Studio may suspend or terminate the Agreement by written notice to you.
